On Dec 11th, 2013,  Justices Singhvi and Mukhopadhyay of Supreme Court overturned the historical Delhi High Court Judgement which had decriminalized private, adult, consensual and non-commercial same-sex conduct. The Supreme Court has left it to the Indian Politicos sitting in the Parliament to decide how consenting adults should conduct in their bedroom. With this Judgement, Supreme Court of India has lost a historical opportunity to expand the constitutional values. Since it has been left to the politicians to decide the conduct of consenting individuals in their private space, lets look at some of the views coming in from various politicos on this issue.
Congress for a change has not kept mum about this issue, even though in the past they have flip-flopped their stance regarding Section 377. Congress President Sonia Gandhi came out strongly against the SC Judgement with the following statement:
Rahul Gandhi, Kapil Sibal and P Chidambaram made televised statements against the Supreme Court ruling. If Congress is really serious about it’s opposition to Section 377, they should take urgent steps to reverse the SC order.
While Congress has been vocal about this particular issue, BJP leadership has been largely mum about this issue save and except Subramanian Swamy who has been very vocal in his support of the Supreme Court Judgement which is very evident from his Twitter timeline.
Such atrocious statements coming from BJP leaders should be a cause for alarm for LGBT community all over India.
Baba Ramdev who admittedly has been campaigning for BJP all over Madhya Pradesh and Chhattisgarh for the elections also came out in support of the SC Judgement and did his bit in marketing the ‘magic drugs’ that are sold from his Ashram in a televised statement.
“I invite the gay community to my yoga ashram and I guarantee to cure them of homosexuality. Homosexuality is not genetic. If our parents were homosexuals, then we would not have been born. So it’s unnaturalâ€
It is not surprising that it was Baba Ramdev’s associate, SK Tijarawala, who was one of the petitioners in this case. With BJP leaders and BJP Activists coming out strongly in favour of the SC Judgement, there is a growing clamour for the BJP Central Leadership and their Prime Ministerial Candidate Narendra Modi to come out in open with their stance regarding Section 377.
Can LGBT community expect support from a BJP/NDA Government for the most basic human rights?
