No Amnesty for War Crimes - Landmark Judgement by Supreme Court of Nepal

Subject: Landmark Judgement of Nepalese Supreme Court

Nepalese Supreme Court gave landmark judgement that serious crimes should not be the subject of Amnesty and declared ultra vires a several provisions of - Commission on Disappearance and Truth and Reconciliation Commission Act. The 234 conflict victims and their organizations filled petition in Supreme Court to challenge tthe CoD and TRC act. I represented the side of victims in Supreme Court.

The Major points of Supreme Court judgement:

- No Amnesty for serious crimes such as - War crimes, disappearances,
Torture, rape etc.
- Commission can not take away the power of the Court.
- No statute of limitations for serious crimes.
- The act of disappearance needs to be criminalized.
- Consent of the victims is must for reconciliation
- Recommendation made for prosecution by Commission is mandatory.
