Subject: Concerns with and recommendations for the revision of MGNREGA wage rates

Dear Shri Nagesh Singh,

NREGA Sangarsh Morcha is a national level platform of trade unions, people’s organisations, NGOs and individuals who are engaged in ensuring people’s rights to fair wages and guaranteed employment under the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA). We have seen from news reports that a committee under your chairmanship is engaged in considering issues related to the wage rate in MGNREGA. We would therefore like to bring the following to the attention of your committee:

1. MGNREGA schemes involve work that is equivalent to work done in agriculture or in construction work. However, MGNREGA wages are below the declared minimum wage for agriculture and for construction work in many states. This is in direct violation of the fundamental right to equality given in Article 14. It also violates the fundamental right to life guaranteed by Article 21, forcing people to work at less than subsistence wages. In fact, working for less than the minimum wage amounts to forced labour, as per Supreme Court orders and is in violation of Article 23 of the Constitution that prohibits forced labour.

2. The base wage for the MGNREGA wage being well below the minimum wage in various states, revisions once every year according to the CPI-AL have resulted in minuscule and ridiculous increase in wages. For 2017-18, the wage revision has been as little as Re 1 for Assam, Bihar, Jharkhand, Uttar Pradesh and Uttarakhand.

3. On the other hand during this same period, with the same rates of inflation, the Seventh Pay Commission has awarded a minimum wage of Rs.18,000 per month for government employees (which amounts to Rs 692 per day for 26 days of work in a month). Please note that this monthly wage is more than what a household in many states would earn from a 100 days of MGNREGA work.

4. Revision of MGNREGA wages due to inflation takes place only once a year, while it is the norm that wages are revised twice a year for workers in most industries and occupations.

5. The Act states that MGNREGA has been enacted for livelihood security. However, with such low wages (combined with long delays in payments), the Act does not provide such security. In fact, workers are being forced to migrate and work in precarious conditions in far-away places. There has been little improvement in livelihood security, with workers just as vulnerable to unemployment and hunger in their own villages and susceptible to exploitation by contractors and agents and bondage as migratory workers. The need to raise wages is all the more urgent as persistent delays in payments further reduce the ‘real’ wages that people get.

6. States are following disparate methodologies for calculation of their minimum wages. Most importantly, they are ignoring the well accepted recommendations laid down by the 15th Indian Labour Conference and the Ackroyd Committee, which have been upheld time and again by the Supreme Court and the Supreme Court orders in the Raptakos Brett case for calculation of minimum wage (See Annexure or http://www.ntui.org.in/what-we-do/minimum-wage/a-just-minimum-wage/).

7. The Seventh Pay Commission has also used these norms to determine the minimum wage for government employees.

In these circumstances we would like to place the following demands before your committee:

1. As has been recommended by the Seventh Pay Commission, the Government of India should declare a floor level minimum wage for the country based on the recommendations of the 15th Indian Labour Conference, the Akroyd Committee and the Supreme Court orders in the Raptakos Brett case. This should be the wage for MGNREGA and all minimum wages declared by states should be equal to or above this minimum floor.

2. The Consumer Price Index Rural should be used to revise the wages every year thereafter instead of Consumer Price Index Agriculture as the former is more representative of the current rural consumption basket. In addition, wage revision should take place every six months, in keeping with the practice for other trades and occupations.

विषय: मनरेगा मज़दूरी के संशोधन की वरॠतमान पॠरकॠरिया से समॠबंधित चिंताठं व सॠठाव.

आदरणीय शॠरी नागेश सिंह,

नरेगा संघरॠष मोरॠचा जन संगठनों, गैर-सरकारी संसॠथाओं, टॠरेड यूनियनों व अनॠय लोगों का ठक राषॠटॠरीय मंच है जो मज़दूरों के महातॠमा गांधी राषॠटॠरीय रोज़गार गारंटी कानून (मनरेगा) के अधिकारों पर काम करता है. खबरों से हमें पता चला कि आपकी अधॠयकॠषता में ठक कमिटी का गठन हॠआ है जो मनरेगा मज़दूरी में संशोधन पर विचार विमरॠश करेगी. इस सनॠदरॠभ में हम आपका धॠयान निमॠन मॠदॠदों की ओर आकरॠषित करना चाहेंगे:

• मनरेगा का काम खेती व निरॠमाण कारॠय के समान है. परनॠतॠ, मनरेगा मज़दूरी कई राजॠयों की खेतिहर मज़दूरी व निरॠमाण कारॠय की मज़दूरी से कम है. यह संविधान की धारा 14 में दिठगठसमानता के मौलिक अधिकार का हनन है. इतनी कम मज़दूरी में काम करवाना धारा 21 में दिठगठजीने के अधिकार का भी हनन है. बलॠकि, सरॠवोचॠच नॠयायालय का आदेश है कि नॠयूनतम मज़दूरी से कम में काम करवाना बंधॠआ मज़दूरी के सामान है और संविधान की धारा 23 बंधॠआ मज़दूरी पर रोक लगाती है.
• चूंकि कई राजॠयों में मनरेगा मज़दूरी नॠयूनतम मज़दूरी से कम है, मनरेगा मज़दूरी का सालाना Consumer Price Index – Agriculture (CPI – AL) के अनॠसार संशोधन ठक मज़ाक बन गया है. 2017-18 में तो असम, बिहार, ठारखंड, उतॠतर पॠरदेश और उतॠतराखंड की मनरेगा मज़दूरी पिछले साल की तॠलना मातॠर ठक रॠपये ही बॠी.
• परनॠतॠइस ही दौरान, सातवें वेतन आयोग ने सरकारी करॠमचारियों के लिठ18,000 रॠपठपॠरति महीने की नॠयूनतम मज़दूरी तय की है (यानी 692 रॠपये पॠरति दिन, महीने में 26 दिन काम करने के लिठ). कॠछ राजॠयों के गॠरामीण परिवार तो मनरेगा में 100 दिन काम करने के बाद भी सातवे वेतन आयोग दॠवारा तय की गई नॠयूनतम मासिक मज़दूरी नहीं कमा पाठंगे.
• मनरेगा मज़दूरी का संशोधन साल में ठक बार ही होता है, जबकि अधिकतर वॠयवसायों के मज़दूरों की मज़दूरी साल में दो बार बॠती है.
• मनरेगा कानून में लिखा गया है कि इस कानून का उदॠदेशॠय आजीविका सॠरकॠषा है. परनॠतॠ, इतनी कम मज़दूरी और भॠगतान में इतने लमॠबे विलमॠब के कारण मनरेगा यह उदॠदेशॠय पूरा नहीं कर पा रहा है. इसके कारण मज़दूरों को अभी भी मजबूरी में पलायन कर अपने गाठव से दूर काम करना पड़ रहा है. अभी भी मज़दूर भूख, बेरोज़गारी और बिचौलियों दॠवारा शोषण के शिकार हो रहे हैं. मनरेगा मज़दूरी को तॠरंत बॠाना इसलिठभी आवशॠयक है कॠयोकि भॠगतान में लमॠबे विलमॠब के कारण मज़दूरी का वासॠतविक मूलॠय और कम हो जाता है.
• राजॠय अपनी नॠयूनतम मज़दूरी निरॠधारित करने के लिठअलग अलग पॠरणालियाठअपनाते हैं. परनॠतॠवे 15वें भारतीय मज़दूर समॠमलेन और ठकॠरोइड कमिटी की अनॠशंसाओं व रैपॠटाकौस बॠरेट मामले में सरॠवोचॠच नॠयायालय के आदेश को नज़रंदाज़ कर देते हैं.[1] सातवें वेतन आयोग ने भी सरकारी करॠमियों की नॠयूनतम मज़दूरी तय करने के लिठइन मानकों का पॠरयोग किया है.

इस परिपॠरेकॠषॠय में हम आपकी कमिटी से निमॠन मांगे करते हैं:

• जैसा कि सातवे वेतन आयोग ने अनॠशंसा की है, भारत सरकार 15वें भारतीय मज़दूर समॠमलेन, ठकॠरोइड कमिटी की अनॠशंसाओं व रैपॠटाकौस बॠरेट मामले में सरॠवोचॠच नॠयायालय के आदेशों के अनॠसार देश के लिठठक नॠयूनतम मज़दूरी घोषित करे. मनरेगा मज़दूरी और राजॠयों की नॠयूनतम मज़दूरी इस निरॠधारित मज़दूरी से कम न हो.
• उसके बाद मनरेगा मज़दूरी का संशोधन Consumer Price Index Rural (CPI R) के अनॠसार हो और न कि CPI – AL चूंकि CPI R वरॠतमान सॠथिति को अधिक सटीक दरॠशाता है. अधिकतर वॠयवसायों की भाठति, मनरेगा मज़दूरी का भी साल में दो बार संशोधन हो.
